Law360, New York (November 14, 2006, 12:00 AM ET) -- A U.S. appeals court Tuesday upheld a district court ruling giving pharmaceutical companies Teva and Ranbaxy the exclusive rights to sell a generic version of Merck & Co. Inc.’s popular cholesterol drug Zocor.
The U.S. Court of Appeals for District of Columbia Circuit affirmed the lower court’s decision that the Food and Drug Administration erred when it denied Israel-based Teva Pharmaceutical Industries Ltd. and India-based Ranbaxy Laboratories Ltd. an exclusive marketing period for their generic drug.
