Appeals Court Revives Patent Suit Over Spinal Screws

Law360, New York (November 20, 2006, 12:00 AM ET) -- A federal appeals court has revived part of a patent infringement lawsuit brought by Johnson & Johnson subsidiary DePuy Spine against the spinal business of Medtronic Inc.

On Monday, the U.S. Court of Appeals for the Federal Circuit overturned a ruling by a federal district judge who had dismissed J&J's allegations that Medtronic's Vertex system of spinal surgery screws infringed on a patent DePuy licenses from Germany’s Biedermann Motech GmbH.
