Law360, New York (January 22, 2010, 6:36 PM ET) -- A federal appeals court has upheld a ruling that Teva Pharmaceutical Industries Ltd.’s proposed generic version of Prevacid did not infringe a patent covering Takeda Pharmaceutical Co. Ltd.’s acid reflux drug.
In a brief order, the U.S. Court of Appeals for the Federal Circuit on Friday affirmed a Delaware district court’s November decision that Takeda had failed to prove infringement on the remaining patent-in-suit.
