Importers Infringed Crocs Design Patent: Fed. Circ.

Law360, New York (February 24, 2010, 6:14 PM ET) -- A federal appeals court has overturned a U.S. International Trade Commission ruling that squashed Crocs Inc.'s infringement claims against several rivals by finding one patent for the company's colorful clogs not infringed and another patent invalid.

The U.S. Court of Appeals for the Federal Circuit on Wednesday ruled that the ITC had erred both in finding that prior art invalidated Crocs-held U.S. Patent Number 6,993,858 and in determining that the rival shoemakers had not infringed U.S. Patent Number D517,789.
