High Court Limits PMPA Claims From Station Owners

Law360, New York (March 02, 2010, 4:10 PM ET) -- In a victory for oil companies that want to raise their franchisees' rents, the U.S. Supreme Court ruled Tuesday that eight gas station owners in Massachusetts cannot bring federal Petroleum Marketing Practices Act claims against Shell Oil Co. while at the same time continuing to operate.

Justice Samuel Alito, writing for a unanimous court, said the PMPA prohibits only such conduct that forces an end to the franchisee’s use of the franchisor’s trademark, purchase of the franchisor’s fuel or occupation of the franchisor’s service station....
