Law360, New York (May 10, 2010, 5:37 PM ET) -- A federal appeals court has rebuffed a bid to revive five lawsuits in multidistrict litigation alleging Hoffmann-La Roche Ltd.'s acne treatment Accutane causes inflammatory bowel disease.
A three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit said Friday that a lower court did not err by excluding the expert testimony of Dr. Ronald Fogel and subsequently granting summary judgment to the defendant in the cases of Eileen Baril, Kenneth Palmer, Christopher Perronne, Clay Seymour and Jason Adkins.
