9th Circ. Hangs Up On T-Mobile Fees Class Action

Law360, New York (May 11, 2010, 2:06 PM ET) -- A federal appeals court has affirmed the dismissal of a breach of contract putative class action accusing T-Mobile USA Inc. of unlawfully charging customers fees related to government-mandated programs.

The ruling on Monday in the U.S. Court of Appeals for the Ninth Circuit affirmed a February decision in the U.S. District Court for the Western District of Washington that said the plaintiffs did not plausibly allege a breach of contract claim.
