Law360, New York (September 16, 2010, 4:32 PM ET) -- A federal appeals court has upheld the dismissal of a trademark infringement suit launched Georgia-Pacific Consumer Products LP launched against a sanitary supply distributor over a particular model of paper towel dispenser.
The trial court correctly ruled that Georgia-Pacific failed to prove that Myers Supply Inc. had contributed to the infringement of the enMotion paper towel dispenser, a three-judge panel ruled in the U.S. Court of Appeals for the Eighth Circuit on Wednesday.
