Calif. Appeals Court Lets J&J Motrin Suit Proceed

Law360, New York (February 10, 2011, 5:58 PM ET) -- A California appeals court has affirmed a lower court's decision not to dismiss a lawsuit alleging that Johnson & Johnson should have included a warning on its pain reliever Motrin about the risk of developing serious skin conditions.

In a ruling issued Jan. 20 and made public Wednesday, the Court of Appeal of the State of California denied a petition by Johnson & Johnson and its unit McNeil Consumer Healthcare Division challenging a lower court's decision to deny the their bid for summary judgment.
