Law360, New York (February 22, 2011, 2:29 PM ET) -- The National Childhood Vaccine Injury Act preempts state law claims against vaccine makers over alleged design defects, the U.S. Supreme Court ruled in a 6-2 decision Tuesday.
The court’s decision in the hotly anticipated Bruesewitz v. Wyeth Inc. represents a major victory for vaccine makers and deals a solid blow to the families of children injured by vaccines, including several thousand who claim vaccines for measles, mumps and rubella gave their children autism.
