GSK Sales Reps Seek 9th Circ. Rehearing On OT Status

Law360, New York (March 08, 2011, 3:12 PM ET) -- GlaxoSmithKline PLC pharmaceutical sales representatives ruled exempt from overtime pay laws asked the Ninth Circuit for a rehearing of their appeal Monday, claiming the panel wrongly rejected the U.S. Department of Labor's position and created a circuit split.

The plaintiffs filed a petition for a panel rehearing and for rehearing en banc in an effort to overturn a decision that found GSK rightly considered its pharmaceutical sales representatives outside sales employees exempted from the Fair Labor Standards Act's overtime requirements.
