Law360, New York (April 06, 2011, 10:17 PM ET) -- Former Enron CEO Jeffrey Skilling, currently serving a 24-year prison sentence for bringing down the Houston energy giant, lost an appeal of his 2006 conviction in the Fifth Circuit that hinged on the U.S. Supreme Court's invalidation of prosecutors' honest services theory.
The U.S. Court of Appeals for the Fifth Circuit affirmed Skilling's convictions, saying that prosecutors' use of the honest services theory was a harmless error that had no bearing on the jury's decision to convict Skilling for conspiracy.
