Law360, New York (July 11, 2011, 9:23 PM ET) -- The Ninth Circuit on Monday ordered the Obama administration to say whether it plans to defend the constitutionality of the military's controversial "don't ask, don't tell" rule barring openly gay service members.
A merits panel for the appeals court said it was apparent that the federal government was not preparing a defense of DADT, and gave the government 10 days to advise the court whether it intended to tell Congress if it will not defend the law, which lawmakers voted to repeal in December.
