Law360, New York (October 31, 2011, 3:30 PM ET) -- The Federal Circuit on Monday refused to reconsider a July decision reversing part of a $5 million judgment for Retractable Technologies Inc. in a suit against Becton Dickinson & Co. over three patents for retractable syringes, rejecting Retractable's requests for a rehearing.
The Federal Circuit rejected bids both for a panel rehearing and a rehearing en banc, yet three judges dissented, including Judges Kimberly A. Moore, Kathleen M. O'Malley and Randall R. Rader, who argued the case was a perfect vehicle to rework some ill-considered precedents....
