DC Circ. Upholds Unionization Rule For Air, Rail Workers

Law360, New York (December 16, 2011, 5:48 PM ET) -- The D.C. Circuit on Friday upheld a lower court’s ruling holding that the National Mediation Board's adoption of a rule that makes it easier for unions in the airline and rail industries to organize does not contradict federal labor law.

A three-judge panel affirmed the decision which held that the NMB did not violate the Railway Labor Act or the Administrative Procedure Act by taking up the rule, and was not arbitrary or capricious in deciding to do so.
