Supreme Court Requests Solicitor General's Views In LabCorp. Patent Suit

Law360, New York (February 28, 2005, 12:00 AM ET) -- The U.S. Supreme Court has asked for the U.S. Solicitor General's views in a case that hinges in part on whether U.S. law allows the patenting of scientific facts.

The move could mean a chance for a rematch for LabCorp. after the U.S. Court of Appeals for the Federal Circuit denied the company’s petition for a rehearing of a lawsuit brought by Competitive Technologies (CTT) on behalf of two university clients over a homocysteine assay patent.
