Law360, New York (March 02, 2012, 6:06 PM ET) -- The Sixth Circuit on Friday reversed a federal court's dismissal of an air conditioner and refrigeration company's suit alleging cartel activity in the copper tubing market, saying the company's claims are sound enough to merit the court's consideration.
The appeals court ruled that the Tennessee federal court had been wrong to grant a motion to dismiss filed by Finnish copper company Outokumpu Oyj, saying that Carrier Corp.'s suit presented valid arguments despite largely drawing from the results of a European investigation into the alleged cartel activity....
