Katrina Policyholders Dealt Another Blow

Law360, New York (August 07, 2007, 12:00 AM ET) -- An appellate court has handed insurers, including State Farm Fire & Casualty Co. and Allstate Indemnity Co., another victory in their ongoing battle with Hurricane Katrina policyholders over who should pay to repair damages caused by the storm.

On Monday, the U.S. Court of Appeals for the Fifth Circuit upheld a district court's ruling dismissing the homeowners' claims, compelled by the insurers' argument that they were not liable for the hurricane-driven flood damage under Louisiana law.
