FERC Reprimanded In Calif. Energy Crisis Dispute

Law360, New York (August 27, 2007, 12:00 AM ET) -- An appeals court on Friday ruled that FERC had abused its discretion by denying California's request for refunds over energy it bought from the Pacific Northwest, but did not rule on any of the Pacific Northwests' refund requests.

The Court of Appeals for the Ninth Circuit granted parts of the appeal, brought by governmental entities from the Pacific Northwest, including Seattle and Tacoma, as well as the State of California, the Public Utilities Commission of California and the California Elecetricity Oversight Board.
