Modified Protective Order Upheld In DuPont, Kolon Fight

Law360, New York (May 02, 2012, 8:16 PM ET) -- The Fourth Circuit rejected a challenge Wednesday from Kolon Industries Inc. to a trial court decision Kolon said gave DuPont Co. free rein to volunteer confidential information gleaned from Kolon in a trade secrets case to Korean criminal and antitrust authorities.

A three-judge appeals court panel concluded that it had jurisdiction under the collateral order doctrine but refused to reverse the lower court's June 2011 ruling that granted DuPont's bid to modify an agreed protective order.
