9th Circ. Says Hexcel's Antitrust Claims Are Time-Barred

Law360, New York (June 01, 2012, 6:56 PM ET) -- The Ninth Circuit said that price-fixing claims by carbon fiber manufacturer Hexcel Corp. were time-barred under the applicable four-year statute of limitations in its suit against rival Ineos Polymers Inc., upholding a lower court's ruling on Friday.

In a unanimous opinion, the appeals court panel upheld the granting of summary judgment to Ineos, formally known as BP Amoco Polymers, Inc., because Hexcel failed to offer evidence sufficient to create any genuine issues of material fact.
