Law360, New York (June 22, 2012, 5:25 PM ET) -- Texas' highest court on Friday ruled that employees cannot bring claims against workers' compensation insurers for unfair settlement practices under the state's insurance code in a dispute involving Texas Mutual Insurance Co.
In a second opinion following a rehearing, the Texas Supreme Court reaffirmed its earlier ruling that respondent Timothy J. Ruttiger could bring claims only under the Texas Workers' Compensation Act, not the state insurance code. The ruling reverses the appeals court's decision and renders judgment for the insurer.
