8th Circ. Says Retaliation Claims Require New EEOC Charge

Law360, New York (August 01, 2012, 8:37 PM ET) -- The Eighth Circuit ruled on Wednesday that plaintiffs seeking to bring retaliation claims over the filing of a discrimination charge with the U.S. Equal Employment Opportunity Commission must first lodge a new charge with the agency.

In a published 2-1 decision, the appeals court affirmed the dismissal of Mischelle Richter's retaliation claims against Advance Auto Parts Inc. under both Title VII and Missouri law for failure to exhaust administrative remedies, rejecting her contention that retaliation claims arising from a charge filed with the EEOC are excepted...
