9th Circ. Says Utilities Must Comply With DEA Subpoenas

Law360, New York (August 10, 2012, 7:01 PM ET) -- The Ninth Circuit ruled Tuesday that utilities must turn over power consumption records, credit card data and other information from customers under a Drug Enforcement Agency subpoena, regardless of whether they relate to the crime being investigated.

“The information being subpoenaed does not need to be relevant to a crime; in fact it may be used to dissipate any suspicion of a crime,” the court’s three-judge panel wrote. “The information subpoenaed need only be relevant to an agency investigation.”
