7th Circ. Says Kanye West Didn't Infringe Song Lyrics

Law360, New York (August 20, 2012, 7:19 PM ET) -- The Seventh Circuit said Monday that hip-hop star Kanye West didn't steal the lyrics for his Grammy-winning song “Stronger” from a little-known rapper named Vince Peters, affirming an Illinois federal judge's decision to toss Peters' infringement lawsuit.

The appeals court agreed with U.S. Judge Virginia M. Kendall that the similarities between the songs — like references to British model Kate Moss or to the saying “what does not kill me, makes me stronger” — were not protectable elements under copyright law.
