Law360, New York (December 21, 2012, 1:25 PM ET) -- The Texas Supreme Court on Friday struck down a $4.7 million award to MasTec North America Inc. for extra costs it incurred in contract work replacing a butane pipeline for El Paso Field Services LP, reversing an appeals court decision.
The high court voted 6-3 to reinstate the trial court decision that originally vacated the jury award, with the majority concluding that the contract allocated all risk to MasTec for unknown obstacles discovered during the construction process.
