Law360, New York (September 24, 2005, 12:00 AM ET) -- Escalating a spar over attorney fees in a semiconductor patent suit, a district judge must reconsider his justification for halving fees requested by Samsung and denying fees to its co-defendant, the Federal Circuit ruled.
The appeal stems from a contempt action brought by International Rectifier Corp. (IR) based on supposed violations of a permanent injunction won by IR against semiconductor rivals Samsung and Ixys Corp. The district judge reduced and denied attorney fees, noting that his only justification was that the case “has been terribly over-lawyered”....
