DC Circ. Nixes NLRB Rehearing Bid In Notice Posting Fight

Law360, New York (September 04, 2013, 7:31 PM ET) -- The D.C. Circuit rejected a bid by the National Labor Relations Board Wednesday for rehearing of a May decision that vacated an NLRB rule that would have required employers to post notices apprising workers of their right to unionize.

The appeals court issued two orders denying the labor board's July 22 petition for panel rehearing and rehearing en banc, leaving intact a victory for the National Association of Manufacturers, the Coalition for a Democratic Workplace and others that challenged the rule.
