Facebook 'Like' Shielded By Constitution, 4th Circ. Says

Law360, New York (September 18, 2013, 1:25 PM ET) -- The Fourth Circuit ruled Wednesday that clicking Facebook's “Like” button is speech covered by the First Amendment, breathing new life into a suit brought against a Virginia sheriff by former deputies who claimed they were let go for supporting a rival candidate for the sheriff's job.

An appellate panel rejected the lower court's conclusion that “liking” a Facebook page was insufficient to merit constitutional protection, reversing a decision to grant summary judgment to Hampton, Va., Sheriff B.J. Roberts on reinstatement claims from three former deputies....
