Board Finds Spirits’ Vodka Trademark Misleading

Law360, New York (February 20, 2008, 12:00 AM ET) -- Spirits International NV will not be able to register a trademark for its vodka, now that the U.S. Patent and Trademark Office’s appeal board has agreed with an earlier decision that the mark’s association with Moscow is geographically misleading.

Spirits had aimed to register the mark “Moskovskaya,” which means “of or from Moscow” in Russian, for its vodka even though the product would not be made, produced or sold in Russia’s capital city that is well known for its vodka.
