EEOC Investigations Bear Growing Court Scrutiny

Law360, New York (April 18, 2014, 6:19 PM ET) -- Following a pattern of decisions over the past year, the U.S. Equal Employment Opportunity Commission recently suffered another significant defeat in federal court. On March 10, 2014, U.S. District Judge Richard J. Arcara of the U.S. District Court for the Western District of New York adopted the report and recommendation of Magistrate Judge Jeremiah J. McCarthy and granted summary judgment in favor of Sterling Jewelers Inc. in the EEOC’s lawsuit alleging a nationwide pattern and practice of employment discrimination.
