Law360, New York (May 23, 2008, 12:00 AM ET) -- Energy provider NiSource Inc. said Thursday that it planned to appeal a $404 million verdict in a price-fixing class action to the U.S. Supreme Court.
The Supreme Court of Appeals of West Virginia decided not to hear the company’s appeal of the multimillion verdict.
In January 2007, a West Virginia jury handed down the $404 million verdict in a class action alleging that a former NiSource subsidiary, Columbia Natural Resources LLC, underpaid royalties and engaged in price-fixing with another company.
