Law360, New York (July 03, 2008, 12:00 AM ET) -- Harman Mining and its owner Hugh Caperton filed an appeal Wednesday with the U.S. Supreme Court over a West Virginia Supreme Court ruling that nullified a $76.3 million verdict against Massey Energy Co.
The West Virginia Supreme Court voted 3-2 in April to overturn the award of $50 million plus interest, upholding the decision it rendered in November before the judicial controversy exploded.
