Planned NM Mine Falls Under Federal Law: 10th Circ.

Law360, New York (April 21, 2009, 12:00 AM ET) -- In a dispute over a proposed New Mexico uranium mine, a federal appeals court has shut down drilling company Hydro Resources Inc.’s challenge to a U.S. Environmental Protection Agency designation of the property as Indian country, subjecting the area to federal rather than state law.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit on Friday denied Hydro’s petition for review and upheld the EPA’s decision, which classified the Hydro-owned property at issue as part of Navajo-based community the Church Rock Chapter....
