US House Lawmakers Weigh Bill To Overturn Riegel

Law360, New York (May 11, 2009, 12:00 AM EDT) -- Legal experts clashed Tuesday over whether legislation to overturn the U.S. Supreme Court's decision in Riegel v. Medtronic will help or hurt patients by restricting their ability to sue over faulty medical devices.

In a subcommittee hearing before the U.S. House Committee on Energy and Commerce, Georgetown University law professor David Vladek said the ruling gives medical device makers broad immunity from tort liability, taking away their incentive to recall faulty products and leaving injured patients no recourse.
