Plaintiffs Lose Bid For Judgment In Vioxx ERISA MDL

Law360, New York (May 11, 2009, 12:00 AM EDT) -- A federal judge has denied a partial summary judgment motion by the plaintiffs in an Employee Retirement Income Security Act suit over Merck & Co.'s shelved painkiller Vioxx. The motion had sought a finding that Merck failed to evaluate the prudence of investing in the company's stock, but the judge ruled that granting it would not speed up the litigation.
