Willfulness Claim Pared From Whitening Patent Suit

Law360, New York (May 13, 2009, 12:00 AM ET) -- A federal judge has ruled that McNeil-PPC Inc. did not willfully infringe a Procter & Gamble Co. patent with its Listerine Whitening Quick Dissolving Strips, but let several other infringement claims move ahead in the spat over teeth-whitening products.

Judge Barbara B. Crabb ruled on a slew of summary judgment motions in the U.S. District Court for the Western District of Wisconsin on Monday, trimming the issues for trial down to whether the Listerine strips infringe 19 claims of U.S. Patent Number 6,949,240.
