EPA Further Delays Bush-Era NSR Revision

Law360, New York (May 14, 2009, 12:00 AM EDT) -- The U.S. Environmental Protection Agency has once again delayed implementing a last-minute Bush administration revision to the New Source Review program's aggregation policy, saying it needs more time to reconsider the matter.

When the Obama administration came into office, it delayed the effective date of the Bush rule from Feb. 17 until May 18 after receiving a petition from the Natural Resources Defense Council. Then, on Thursday, the EPA said the effective date would be pushed back 12 more months until May 18, 2010.
