EU Court Upholds Limits On Pharmacy Ownership

Law360, New York (May 19, 2009, 12:00 AM EDT) -- A European court has upheld laws in Germany and Italy barring nonpharmacists from owning pharmacies, dealing a blow to Celesio AG, Europe’s largest drug wholesaler, which had hoped to open a pharmacy chain.

The European Court of Justice ruled Tuesday that such laws are justified because “the operation of a pharmacy by a nonpharmacist may represent a risk to public health, in particular to the reliability and quality of the supply of medicinal products at retail level.”
