Law360, New York (May 22, 2009, 12:00 AM ET) -- Finding a lower court's claim construction for a patent that covers an exercise monitoring system to be too narrow, a federal appeals court has vacated and remanded a judgment of noninfringement for watchmaker Timex Corp.
In an opinion handed down Friday, the U.S. Court of Appeals for the Federal Circuit reconstructed two claims for the patent, issued to Paragon Solutions LLC, and rejected Timex's asserted alternative basis for affirmation of a claim term related to real-time data.
