Bilski Kills Patent In 'Keep The Change' Suit V. BofA

Law360, New York (May 29, 2009, 12:00 AM ET) -- A federal judge has ruled that Bank of America Corp.'s “Keep the Change” program does not infringe Every Penny Counts Inc.'s patent for a system that allows consumers to save a portion of a credit or debit transaction, ruling that the U.S. Court of Appeals for the Federal Circuit's decision in In re: Bilski invalidates the patent.
