Cablevision DVR Spat Not Ripe For High Court: DOJ

Law360, New York (May 29, 2009, 12:00 AM ET) -- The U.S. Department of Justice has urged the U.S. Supreme Court to reject a suit brought by major television networks and movie studios that Cablevision Systems Corp.’s next-generation television recording device violates copyright protections.

In an anticipated brief, U.S. Solicitor General Elena Kagan recommended that the high court deny the petitioners’ bid for writ of certiorari and wait to address the copyright questions at issue until a legitimate judicial schism warrants the court’s clarification.
