Retirees Win Class Cert. In Bemis ERISA Suit

Law360, New York (June 1, 2009, 12:00 AM EDT) -- A judge has certified a class of retirees alleging Bemis Co. Inc. breached a plant-closing deal by reducing health benefits, rejecting the packaging company's contention that the agreement didn't apply to workers who retired before its effective date.

On Thursday, Judge J.P. Stadtmueller of the U.S. District Court for the Eastern District of Wisconsin granted class certification in a suit claiming Bemis breached an agreement it made over retiree benefits when one of its plants closed in 1985.
