Insurers Can Get Medical Docs In Fraud Suits: Court

Law360, New York (June 03, 2009, 12:00 AM ET) -- Reversing an appellate court's opinion, the Supreme Court of Ohio has held that insurers have the right to access medical information in civil fraud actions when patients have consented broadly to releasing the records to insurers.

The high court determined Wednesday that the patients' certificates of coverage in this case, which include language indicating their consent to release medical information to their insurer, effectively waive the physician-patient privilege in a civil fraud action filed by Medical Mutual of Ohio.
