Alaska High Court Shoots Down Wage Act Amendment

Law360, New York (June 9, 2009, 12:00 AM EDT) -- The Supreme Court of Alaska has come out with a ruling that will allow a class of Hageland Aviation Services Inc. pilots to collect $1.6 million in unpaid overtime wages.

In an opinion issued Friday, the state high court unanimously affirmed that a 2005 law violated the takings and contract clauses of the Alaska Constitution. The law, an amendment to the Alaska Wage and Hour Act, was specifically passed by the legislature to stop the Hageland case and two other class actions from proceeding, according to...
