High Court Hands Employers Win In FBL Age Bias Case

Law360, New York (June 18, 2009, 12:00 AM EDT) -- The U.S. Supreme Court has made it more difficult for workers to show an employer discriminated against them because of their age, coming down against an employee in his mid-50s who accused FBL Financial Services Inc. of demoting him for being too old.

In a narrow 5-4 ruling, the majority of justices on Thursday held that the responsibility falls on employees asserting federal age discrimination claims to prove that age was the main factor that led to an adverse employment action.
