8th Circ. Revives Ark. Farm Contamination Lawsuit

Law360, New York (June 19, 2009, 12:00 AM ET) -- A federal appeals court has reversed and remanded a district judge's grant of summary judgment against an Arkansas grain farm in a soil-and-water contamination case against Exxon Mobil Corp. and others that was dismissed on statute of limitations grounds.

Friday's per curiam opinion, in the U.S. Court of Appeals for the Eighth Circuit, said the plaintiff's “worry” and “concern” about possible environmental contamination dating back to the mid-1990s was not proper evidence on which to rest the October 2007 summary judgment decision in the U.S. District...
