PNC Fraud Claim Stands In ING Trademark Suit

Law360, New York (June 23, 2009, 12:00 AM EDT) -- In an ongoing infringement dispute over orange ball designs, a judge has rejected ING Direct Bancorp's bid to dismiss a counterclaim filed by rival PNC Financial Services Group Inc. alleging that ING committed fraud in registering a trademark.

Magistrate Judge Leonard P. Stark of the U.S. District Court for the District of Delaware on Monday denied ING's motion to dismiss PNC's counterclaim seeking the cancellation of one of three trademarks at issue in the case.
