Some Alzheimer's Claims Tossed In Mayo Patent Suit

Law360, New York (June 30, 2009, 12:00 AM EDT) -- A judge has dismissed two of the four counterclaims filed by Alzheimer's Institute of America Inc. against the Mayo Clinic Jacksonville in a patent dispute over transgenic mice used to research Alzheimer's disease, finding them preempted.

Judge Steven Merryday of the U.S. District Court for the Middle District of Florida ruled Friday that AIA's state law counterclaims of equitable interest and unjust enrichment were preempted by federal patent law because they do not plead conduct that is separate and independent from AIA's patent law claims....
