DuPont Scores In $239M Delrin Liabilities Battle

Law360, New York (July 6, 2009, 12:00 AM EDT) -- A Delaware state judge has handed DuPont Co. a victory over an excess insurer, ruling that $239 million in liabilities related to Delrin — an acetal resin plastic material found to cause property damage — should be covered as a single occurrence.

Judge James T. Vaughn Jr. granted DuPont's motion for summary judgment on June 30 in the Superior Court for the State of Delaware, dismissing Stonewall Insurance Co.'s contention that the damage was the result of multiple occurrences.
